A dispute in Federal Court has of late broke out between a pair of big online dating sites. Anastasia International accused EM Online Ltd. dba Elena’s Models of trademark infractions, false advertising, indirect interference and unfair competition, inside the Manhattan Federal Court. Anastasia employs the domains Anastasiadate and Anastasiadate.com for its site. EM Online is within Australia.
“The Complainant provides an international internet dating service which, for a fee, matches up males in the United States with females located in the Russian Federation and Ukraine. One of the most targeted area of the states is New York”, claims the statement. “EM Online directly impedes upon Anastasia’s market. We have the specified data to assume that EM Online either is managing, or is supporting, websites called: ‘anastasiadatefraud.com’ and ‘ruadventures.com’. Both of these websites disguise the identity of their owners by using a proxy service. To make matters a lot more dubious, these web sites redirect whoever is viewing them to elenasmodels.com. The foundation of the false advertising allegation stands because of the fact that the two websites accuse Anastasiadate of very carefully and consistently ripping off customers and deceive their potential customers when choosing their services, then go on to say that the accused, elenasmodels.com, is really a totally safe and reliable dating site. “The anastasiadatefraud.com website purports to show extracts from e-mails authored by women with profiles on Anastasiadate.com. The e-mail extracts all have a common message – women featured on Anastasiadate.com aren’t truly searching for a relationship with men from the U.S., but instead are contract workers paid to correspond with Anastasia customers and break their hearts. These claims are false, and the e-mails from the women seem to be fake. Anastasiadate’s main concern is to make certain that all the women in the site’s service are genuine girls who are looking for love.”
Elena’s Models knows the claims it makes on anastasiadatefraud aren’t true, and had the emails written specifically to harm Anastasia’s business, the complaint states. Quite unjustly, Elena’s Models is using ruadventures.com to ward off any competition so that it can prosper at their expense. “While trying to hide beneath the cover of an independent, neutral forum site, ruadventures.com actually selectively picks out the positive comments about Elena’s Models and promotes that, while attempting to blast other competition aside. The internet site retains plenty of false advertisement about Anastasiadate, that has ultimately been tinkered with by EM Online,” the complaint states.
Ruadventures.com has illegitimately used aspects of Anastasia’s copyrighted logo, according to Anastasia. “Through self referential tags, while using Anastasia’s trademarks, the websites are now linked to Anastasiadate, which has made them popular search engine results,” the complaint states. Anastasia seeks a preliminary and irreversible injunction, and treble and punitive damages. It is represented by Richard C. Yeskoo with Yeskoo Hogan & Tamlyn.
Anastasiadate.com gives American men the opportunity to meet “a few of the globe’s most breathtaking females!” “Few other international dating webpage comes close,” the site says. The site describes itself as “the easiest way to find real women online, using the best customer protection available on a dating site.”
On anastasiadatefraud.com, an anon author claims that he knows everything in regards to the web site. Anastasiadate pays women to log in and pose as single women seeking love, and are paid for this by the same company, according to him. He claims that he knows this just because a woman he chatted with in Ukraine shared with him how Anastasiadate works. He remarks the third-party agencies offer women “high earnings and flexible schedule” to email and chat with American men. The criteria necessary for this kind of “job” are: to be over 18 years and to be literate in English and in computers.
This author claims the lady he corresponded with prompted him to enroll in Elena’s Models, calling it “a professional online dating site.”
